Civil Court

Cases filed in the civil division of the Clerk’s Office fall either under the jurisdiction of County Court or Circuit Court.

All actions may be filed at the Miami-Dade County Courthouse or at district court locations.

County Court

County Court Cases

County court cases are governed by the rules of civil procedure. These rules cover cases where the amount of damages exceeds $8,000 but is not more than $30,000 as well as tenant eviction cases.

Small Claims Cases

These are cases where the amount of money does not exceed $8,000 exclusive of interest, court costs and attorney fees. These are called small claims cases.

Circuit Court

Circuit court handles cases such as:

  • Cases where the amount of money exceeds $30,000, exclusive of interest, court costs and attorney fees
  • Eviction cases where damages claimed exceed $30,000
  • Actions of ejectment
  • Actions involving the title and boundaries of real property  
  • Issuance of injunctions -such as:
    • Replevin  
    • Negligence  
    • Professional Malpractice  
    • Products Liability  
    • Mortgage Foreclosures  
    • Eminent Domain  
    • Bond Estreatures  
    • Writs  
    • Foreign Judgments

A deputy clerk may be able to assist you with the filing of a small claims suit. Forms are available in Room 137 of the Miami-Dade County Courthouse and at the district court locations. You may need an attorney to assist you on all other matters. Fee schedules and additional information are available at those locations or by calling 305-275-1155.

Non-Criminal Justice Applicant’s Privacy Rights

Pursuant to the FBI Compact Council Agency Privacy Requirements for Non-Criminal Justice Applicants, the Clerk of the Courts as an “Official” must provide the applicant of a Name Change Petition with written Notice of the usage of his/her fingerprints. As such, this Notice serves to inform all applicants pursuing a Name Change that your fingerprints will be used to check the criminal history records of the Federal Bureau of Investigation (FBI).

Criminal Payment Plan Option
You may request to be placed on a payment plan for your criminal case. Once you elect to pay and if your case is not in collection agency status, you will have the option to sign up for a payment plan.

Marriage License appointments now available at all Districts!
Due to COVID-19, the Marriage License Bureau continuesissuing marriage licenses on a limited basis by appointments only, Monday – Friday from 9 a.m.–4 p.m. Beginning January 24, 2022 the Clerk’s Office will expand the current marriage license appointment system to ALL District locations. To expedite the application process, customers must complete the online marriage license pre-application and then schedule an appointment.  We are currently not accepting walk-ins until further notice.

How do I look up a civil court case in Florida?

Visit the Florida Courts website to access court locations in the state. Upon locating the address of the appropriate court, the next step is to make a request to the keeper of records in the court. Court records are typically in the custody of the Clerk of Court.

Can you search Florida court records online?

The public is able to view non-confidential court records via the internet in all non-confidential case types with the exception of cases governed by the Florida Rules of Family Law or the Florida Probate Rules.

How do you find out if you have a lawsuit against you in Florida?

Q: Where can I find judgments, filings, complaints, and divorce decrees (orders), or other case documents or information? A: You must contact the clerk's office at the court where your case was handled. You may find trial court clerks' phone numbers, street addresses, and website addresses through www.flclerks.com.

Are Florida court cases public record?
